Spache

1. Your account

You must provide accurate information, keep your sign-in credentials secure, and make sure that people using your account are authorised to do so. You are responsible for activity performed through your account and for complying with laws that apply to you.

2. Content and permission to cache

You retain responsibility for the websites and content you connect to Spache. You confirm that you own, control, or have permission to use, copy, render, cache, and serve that content through Spache.

You give Spache permission to fetch, process, store, reproduce, transform, and serve copies of that content as needed to provide the service. This includes cached copies, rendered pages, assets, API responses, and related metadata.

3. Prohibited content and use

You must not connect a site or use Spache to store, render, cache, distribute, or facilitate content that is illegal, fraudulent, defamatory, invasive of privacy, abusive, malicious, or harmful.

You must not connect content that infringes copyright, trade mark, trade secret, publicity, privacy, or other rights; contains malware or harmful code; promotes exploitation or abuse; or violates the rules of a third-party service. You must not use Spache to bypass access controls, attack systems, send spam, or interfere with the service.

We may investigate and act on abuse, security, or rights complaints without notice where reasonably necessary. This may include blocking requests, clearing caches, taking a site offline, or suspending an account.

4. Your responsibility for cached content

You are responsible for the content that Spache holds and serves on your behalf, including content that remains available in a cache after it changes at your origin. You must promptly remove or correct content when you no longer have permission to use it, or when it becomes unlawful or harmful.

If you receive a rights complaint or other request concerning content served through Spache, you are responsible for investigating and resolving it. We may remove content, clear caches, suspend a site, or restrict an account where we reasonably believe these terms or another person’s rights may be affected.

After removal, cancellation, or cache clearing, copies may remain briefly in distributed caches, backups, logs, or other systems while they expire or are securely deleted. We do not promise immediate deletion from every system.

You must not send personal, confidential, or regulated information to Spache unless you have a lawful basis and have configured your origin and integrations appropriately. You are responsible for accidental disclosure through cached pages, assets, API responses, or rendered content.

5. Third-party services

Your connected origins, domains, payment providers, and other integrations may have their own terms and availability. Spache is not responsible for third-party services, their content, or changes they make to your site or APIs.

6. Plans, usage, and payment

Spache may provide a free allowance and paid plans with recurring charges or usage-based charges. Usage measurements are estimates until the relevant billing period is finalised. You authorise us and our payment provider to collect amounts that are properly due under your plan.

Prices are shown in the app and may be subject to GST or other applicable taxes. You are responsible for taxes that apply to your purchase unless we are required to collect them. Recurring plans renew until cancelled. Cancellation normally takes effect at the end of the current paid period, while failed or overdue payments may result in immediate restrictions or suspension.

Refunds are handled according to applicable law and any refund terms shown at checkout. We may correct billing errors and may change plan prices or usage rates with reasonable notice.

We may limit or suspend paid features, including connected domains, when an account is unpaid, cancelled, or otherwise not eligible for the relevant plan.

7. Availability and changes

Spache is provided on an availability basis and may change, be interrupted, or contain errors. We may change the service, usage limits, pricing, or these terms. Where practical, we will give notice of material changes. Continuing to use Spache after a change means you accept the updated terms.

8. Suspension and termination

We may suspend or terminate access if you breach these terms, create risk for Spache or others, fail to pay, or if required by law. You can stop using Spache at any time. Ending an account does not remove obligations that arose before termination.

9. Disclaimers and liability

To the extent permitted by law, Spache is provided without warranties about uninterrupted availability, fitness for a particular purpose, or the correctness or persistence of cached content. You remain responsible for maintaining your origin and your own backups.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, remedy, or liability that cannot lawfully be excluded, including rights under the Australian Consumer Law. Where the law permits a limitation, our total liability arising from the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim, or AUD $100 if you paid nothing.

To the extent permitted by law, Spache is not liable for indirect, incidental, special, consequential, or loss-of-data damages arising from your use of the service.

You indemnify Spache and its operators against claims, losses, liabilities, costs, and reasonable legal expenses arising from your connected sites, your content, your breach of these terms, or your infringement of another person’s rights. This does not apply to the extent caused by our own unlawful conduct or negligence.

10. Contact and governing law

If you need to report a rights issue, prohibited content, or a security concern, contact the Spache operator through the support channel provided in the app. These terms are intended to be read with any plan-specific terms shown when you subscribe.

These terms are governed by the laws of Queensland, Australia. You and Spache submit to the courts of Queensland, Australia, except where a law gives you a right to bring a claim elsewhere.
